Effective Date: January 22, 2007 Welcome to the Project Angel Mom Web site (the “Web Site”). These Terms of Service govern your use of the Web Site and your receipt of email messages and other services from Project Angel Mom (“Services”). By using or visiting the Web Site or Services, you expressly agree to follow these Terms of Service and all applicable laws and regulations governing the Web Site and Services. If you do not accept these Terms of Service, you must discontinue use of the Web Site and Services. Weill Media, a division of Angels Landing Productions, Inc., owns and operates the Web Site (“Project Angel Mom” or “we”). Project Angel Mom reserves the right to modify these Terms of Service at any time by posting changes on this Web Site. We encourage you to check these Terms of Service frequently. Your continued use of this Web Site or the Services constitutes your acceptance of the current posted Terms of Service.
Permitted Use of Web Site and Services; Registered Users. The mission of the Web Site and Services is to alert Internet users to individuals and families in need, and to provide information about how Internet users can contribute to them directly. We give you several opportunities to receive these alerts: you can browse the Web Site at your convenience or receive Project Angel Mom emails as a registered user of the Web Site (“Registered User”). Only Internet Users who are U.S. residents and at least 18 years old can register to receive Project Angel Mom emails. By registering to receive Project Angel Mom email, you represent and warrant that you meet Project Angel Mom’s residency and age requirements, and that you will use the Web Site and Services solely for your personal non-commercial home use. To become a Registered User, you will be asked at the Web Site to provide your email address and other information. In the second step, Project Angel Mom will send you a welcome email and ask you to reconfirm your wish to become a Registered User. You may unsubscribe to Project Angel Mom email at any time by following the directions on the Web Site’s registration page. You agree that the information that you provide to the Web Site will be true, accurate, current and complete, and that you will update it promptly for changes. If you violate these Terms of Service, Project Angel Mom may, at our discretion, terminate your registration, remove or modify any content or access related to your registration, or take any other action that Project Angel Mom determines is appropriate. Many Services are available to all users of the Web Site. For example, any user can use the Web Site’s “Tell A Friend” and eCard services to have Project Angel Mom send an email on your behalf to recipients whom you designate.
Privacy. The information that you provide to the Web Site is governed by Project Angel Mom’s privacy policy (the “Privacy Policy”), which is located at http://www.projectangelmom.com/privacypolicy.html. We strongly urge you to review the terms of the Privacy Policy. These Terms of Use incorporate by reference the terms of the Privacy Policy.
Contributions. The individuals featured on the Web Site (“Featured Individuals”) have been selected by Project Angel Mom for their courage in the face of difficult circumstances. Many are fighting serious illness or are recovering from the effects of a criminal act, accident or natural disaster. Project Angel Mom provides information for you to contribute to Featured Individuals directly. Many times, a contribution is to a bank account established for a Featured Individual’s benefit; other times a Featured Individual will ask for the contribution of particular goods. While we make every effort to ensure that the information that we provide is accurate, Project Angel Mom does not independently review, investigate or verify the information provided by the Featured Individuals or their representatives. Project Angel Mom has no involvement in setting up or managing the bank accounts and funds established to help these Featured Individuals, and we do not participate in the distribution of any contributions. We cannot collect or forward contributions received from you, so please do not send contributions or financial information to Project Angel Mom. Project Angel Mom makes no representation or warranty that the contributions will be used for a particular purpose, or that the contributions will lead to a specific outcome, or that any portion of your contribution will qualify for a tax deduction. You agree that Project Angel Mom shall not be responsible or liable to you for the acts or omissions of the Featured Individuals and their representatives, the contribution(s) that you make, or any loss or damage that your suffer as a result.
User Code of Conduct. You agree that you will not use the Web Site or Services:
Project Angel Mom’s Proprietary Rights. The information and materials made available through the Web Site and the Services are the property of Project Angel Mom and its licensors and suppliers, and are protected by U.S. and international copyright, trademark and other rights and laws. So long as you comply with these Terms of Service and are permitted by Project Angel Mom to use the Web Site and Services, you may download one (1) copy of the content on the Site, including downloadable files, to any single computer solely for your personal, non-commercial home use, provided that you keep intact all copyright and other proprietary notices. Except as otherwise expressly authorized in advance by Project Angel Mom, you agree not to reproduce, modify, rent, lease, loan, sell, distribute, or create derivative works based (whether in whole or in part) on, all or any part of the Web Site or any materials made available through the Web Site. Trade names, trademarks and service marks of Project Angel Mom include without limitation PROJECT ANGEL MOM, WING SOMEONE A MIRACLE TODAY, and all associated logos. All trademarks and service marks on the Web Site not owned by Project Angel Mom are the property of their respective owners. Nothing contained on the Web Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Project Angel Mom trade names, trademarks or service marks without our express prior written consent.
Links to Other Web Sites. The Web Site includes links to third-party Web sites. Project Angel Mom has no control over these Web sites or their content. Your use of a third-party Web site is governed by its terms of use and privacy policy. Project Angel Mom cannot guarantee that the content contained on these Web sites is accurate, legal and/or inoffensive, and does not endorse any third party Web site. We do not warrant that a third party Web site will not contain viruses or otherwise impact your computer. If you have a problem with a link from the Web Site, please notify Project Angel Mom at info@ProjectAngelMom.com, and Project Angel Mom will investigate your claim and take any actions Project Angel Mom deems appropriate in our discretion. Other Web sites may link to our Web Site without authorization. Any dealings you have with a third party linked to or from this Web Site are between you and the third party. You agree that Project Angel Mom shall not be responsible or liable for any links to or from a third party Web site to this Web Site, any materials, transactions, products or services available on or through those Web sites, or any loss or damage that you suffer as a result.
Offline Conduct. Although Project Angel Mom cannot monitor the conduct of its users off the Web Site, it is a violation of the Terms of Service to use any information obtained from this Web Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any user without his or her prior explicit consent.
Unauthorized Uses of This Web Site. You agree that you will not use any data mining, robot, or similar data gathering or extraction tool, whether automated or manual, to monitor or copy the Web Site’s content without our prior written permission. You agree that you will not use, reproduce, distribute, create derivative works of, perform, display, or digitally perform any content (except for your own personal, non-commercial use) from the Web Site without our prior written permission. Collection of Information from Minors. The Web Site is directed to, and intended for use by, adults only. We require that a user be 18 years of age or older to become a Registered User (and in doing so, to submit personal information). We do not knowingly collect personal information from children under the age of thirteen. Indemnity. Violation of the Terms of Service. You agree that monetary damages may not provide a sufficient remedy to Project Angel Mom for violations of these Terms of Service and you consent to injunctive or other equitable relief for such violations.
Disputes. If there is any dispute about or involving the Web Site or Services, you agree that the dispute will be governed by the laws of the State of New York without regard to its conflict-of-law provisions. You agree to personal jurisdiction by and exclusive venue in the state and federal courts of the State of New York, County of New York, and waive any jurisdictional, venue or inconvenient forum objections to such courts. If any provision of these Terms of Service is found unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity of the remaining provisions.
